The Calibre Club is a trading name of Asct Holdings Limited.
Registered office: Unit A, 82 James Carter Road, Mildenhall Industrial Estate, Suffolk, IP28 7DE.
Company No. 15776783.

Application of these Terms

  1. These Terms apply to competitions, draws, promotions and instant-win competitions made available by the Promoter through the Website.
  2. Each competition may also have specific terms displayed on its competition page or in separate rules (the "Competition Rules").
  3. The Competition Rules may contain, among other things:
    • the prize or prizes;
    • opening and closing dates;
    • maximum number of entries;
    • entry limits per person;
    • entry price or qualifying purchase;
    • free or no-purchase entry methods;
    • instant-win mechanics;
    • jurisdiction-specific eligibility;
    • prize values and odds information;
    • permits, authorities or registration numbers;
    • winner-verification requirements; and
    • any jurisdiction-specific provisions required by applicable law.
  4. If there is a conflict between these master Terms and Competition Rules containing a mandatory requirement applicable to a particular jurisdiction, the Competition Rules will apply to the extent of that conflict.
  5. Nothing in these Terms excludes or limits any mandatory consumer right or legal protection that cannot lawfully be excluded in the Entrant's jurisdiction.

Competition Formats

The Promoter may operate different types of competition.

  1. Closing Draw Competitions. Eligible entries are placed into a draw and one or more winning entries are selected after the stated Closing Date or at another time specified in the Competition Rules.
  2. Instant-Win Competitions. Certain entry numbers, positions or outcomes may correspond to predetermined or otherwise properly allocated instant-win prizes. The applicable mechanism will be stated in the Competition Rules.
  3. Combined Competitions. A competition may contain both instant-win prizes and a separate closing draw.
  4. Promotional Competitions. In jurisdictions where charging separately for competition entry is not permitted or where a promotional structure is required, entry may instead be provided as a promotional benefit connected with an eligible product, service, membership or other qualifying action.
  5. The availability of a competition format may vary by country, state, province or territory.

How to Enter

  1. Each competition will run during the period stated on its competition page.
  2. Unless stated otherwise, times displayed on the Website are London, United Kingdom time.
  3. To enter through a paid online route where that route is available, an Entrant must normally:
    • create or hold a valid account;
    • choose the relevant competition;
    • select the permitted number of entries;
    • answer any qualifying question required;
    • provide accurate information;
    • complete payment successfully; and
    • comply with any additional Competition Rules.
  4. Where entry is linked to a qualifying product, service, membership or other promotional action, the Competition Rules will explain how promotional entries are earned or allocated.
  5. An Entrant may not exceed any entry limit stated for the competition.
  6. Only one customer account per person is permitted unless we expressly state otherwise.
  7. Entries must be received before the relevant deadline. An attempted payment or submission that has not been successfully completed does not constitute a valid entry.
  8. The Promoter is not responsible for entries not successfully completed because of telecommunications, internet, payment, postal, hardware, software or other technical failures outside its reasonable control.
  9. We may correct an obvious technical or administrative error affecting an entry provided doing so does not unfairly prejudice Entrants or alter a valid competition outcome.
  10. Once accepted, entries participate according to the Competition Rules applicable to the Entrant and competition.

Free & No-Purchase Entry

United Kingdom Where a UK competition operates using a paid and free draw structure, a genuine free postal route is provided. Qualifying free and paid entries participate in the same prize-determination system and are not treated differently because of their method of entry.
  1. For UK competitions offering the postal route, an Entrant may enter without purchasing a ticket by following the instructions on the Free Entry Route page and the applicable Competition Rules.
  2. Unless a competition states otherwise, UK postal entries should be sent by first or second class post to: The Calibre Club, 3rd Floor, 45 Albemarle Street, Mayfair, London, W1S 4JL, United Kingdom.
  3. A postal entry must contain all information specified in the Free Entry instructions. This may include:
    • the Entrant's full name;
    • postal address;
    • email address;
    • telephone number;
    • the competition being entered;
    • the Entrant's answer to any qualifying question; and
    • any other information reasonably required to identify and process the entry.
  4. Each postal entry must be submitted separately where the published Free Entry instructions require separate submissions.
  5. Postal entries must arrive before the applicable deadline. Proof of posting is not proof of receipt.
  6. Where a maximum entry pool or individual entry limit applies, free entries count towards the same applicable limits as other entries.
  7. A qualifying free entry will not be given worse odds or access to an inferior prize pool solely because no purchase was made.
  8. For an Instant-Win competition using a shared entry-number pool, qualifying free entries will be allocated an eligible entry number or position using the mechanism described in the Competition Rules.
  9. For jurisdictions outside the UK, we may provide a different No Purchase Necessary or alternative entry method where required or appropriate.
  10. The applicable international no-purchase method may be online, postal, email or another lawful mechanism and will be described in the Competition Rules.
  11. Entrants must use the no-purchase method made available for their jurisdiction rather than assuming the UK postal method automatically applies worldwide.

Qualifying & Skill Questions

  1. Certain competitions require an Entrant to answer a question correctly before an entry becomes eligible.
  2. The nature and difficulty of the question may differ between competitions and jurisdictions.
  3. An incorrect answer may result in the attempted entry being rejected or otherwise treated in accordance with the Competition Rules.
  4. Where local law requires a winner to answer a skill-testing question before being declared or confirmed as a winner, the selected Entrant must answer that question correctly within the required time and without assistance.
  5. For example, certain Canadian competitions may require a mathematical skill-testing question as part of winner confirmation.
  6. Failure to satisfy a mandatory skill-testing requirement may result in the Entrant being unable to receive the prize and another eligible winner being selected in accordance with the applicable Competition Rules.

Instant Wins

  1. Where a competition includes Instant Wins, the competition page will describe the number and type of instant prizes and the applicable entry-number or prize-allocation mechanism.
  2. Instant-win prizes may be allocated to predetermined winning numbers, positions or another disclosed and controlled mechanism.
  3. The Promoter will not knowingly manipulate a winning position after eligible entries have begun being allocated.
  4. Where winning positions are predetermined, paid and qualifying no-purchase entries participating in the same pool will be capable of receiving winning positions in accordance with the same applicable allocation mechanism.
  5. An Entrant may be informed immediately that their entry corresponds to an Instant Win. This notification remains subject to:
    • entry validation;
    • payment validation where applicable;
    • eligibility;
    • identity and age verification;
    • compliance with any skill-testing requirement; and
    • compliance with these Terms and Competition Rules.
  6. An on-screen or email notification does not override the Promoter's right to correct an obvious technical error, duplicate award, software malfunction or fraudulent transaction.
  7. If a genuine technical malfunction causes a prize to be displayed incorrectly, the Promoter will investigate the relevant audit records and apply the valid competition data and Competition Rules.
  8. Instant Wins may not be offered in every jurisdiction.
  9. Different jurisdictions may have separate rules, permits, promotional structures or prize restrictions for Instant Wins.
  10. Where local law does not permit the applicable Instant-Win structure, Entrants from that jurisdiction will not be eligible for that competition or will be provided with a jurisdiction-specific compliant version where available.

Closing Draws

  1. For a closing draw, all eligible entries applicable to that draw will be entered into the winner-selection process.
  2. Where a paid and free entry route participate in the same UK draw, the prize-selection system will not distinguish between entries because of the route by which they were obtained.
  3. Unless the Competition Rules specify another compliant method, winning entries are selected randomly.
  4. The Promoter currently uses VerifiedDraws.com for independent draw verification of applicable closing draws.
  5. For applicable draws, entrant data is cryptographically recorded or locked before winner selection so that the published draw can be independently verified.
  6. Main closing draws are normally streamed live on the Promoter's Facebook channel and results are subsequently published on the Website.
  7. A technical failure affecting a livestream does not automatically invalidate a draw where the underlying winner-selection process has been validly completed and verified.
  8. If it becomes genuinely necessary to postpone a draw because of circumstances outside our reasonable control, the updated time and any required information will be published as soon as reasonably practicable.

Eligibility & International Entry

  1. Entrants must be aged 18 years or over unless a higher minimum age is stated for their jurisdiction.
  2. The competition is open to UK residents and to residents of other jurisdictions expressly permitted for the relevant competition.
  3. Availability may differ by country, state, province or territory.
  4. The Promoter may maintain a list of jurisdictions from which entries are not accepted.
  5. A person must not enter from a jurisdiction that is expressly excluded by the Competition Rules.
  6. Employees of the Promoter, people professionally involved in administering the competition and members of their immediate household or family are not eligible unless expressly stated otherwise.
  7. By entering, an Entrant confirms that:
    • the information supplied is accurate;
    • they satisfy the applicable age and residency requirements;
    • they are legally capable of accepting the prize; and
    • their participation is not prohibited by laws applicable to them.
  8. Entrants outside the United Kingdom are responsible for checking whether their participation is lawful under rules applicable in their country, state, province or territory.
  9. That responsibility does not prevent the Promoter from imposing its own eligibility restrictions or conducting its own compliance checks.
  10. The mere fact that the Website can be accessed in a jurisdiction does not mean every Calibre Club competition is offered in that jurisdiction.
  11. We may use account information, billing information, delivery information, IP-derived location information and reasonable verification procedures to assess jurisdictional eligibility.
  12. We may request identification, proof of age, proof of address or residency and other information reasonably necessary to confirm eligibility.
  13. An Entrant who deliberately uses false residency information, a VPN or another method to circumvent a geographic restriction may be disqualified.
  14. We may restrict participation where necessary because of:
    • applicable law or regulation;
    • sanctions or export controls;
    • payment-provider restrictions;
    • prize import restrictions;
    • local permit or registration requirements;
    • tax or reporting requirements;
    • prize fulfilment difficulties; or
    • other legitimate compliance reasons.
  15. We may introduce additional jurisdiction-specific terms before making a competition available in a new country or region.
  16. Mandatory consumer protections applicable in an Entrant's country of residence remain unaffected by these Terms.

Prizes & Fulfilment

  1. The prize or prizes for each competition are described on the relevant competition page.
  2. Prize descriptions may specify:
    • brand and model;
    • reference;
    • approximate retail or market value;
    • new or pre-owned condition;
    • box and papers;
    • warranty;
    • cash alternative where offered; and
    • other material characteristics.
  3. Every watch awarded by The Calibre Club will be genuine.
  4. UK prizes are generally sourced through reputable specialist or established watch-market channels.
  5. For an international winner, the Promoter may, where practical, source and fulfil the prize within the winner's country or region rather than unnecessarily exporting the prize from the United Kingdom.
  6. Where a prize is described by model and specification rather than as a particular identified serialised item, a locally sourced watch may be used provided it materially meets the advertised prize specification.
  7. If the competition expressly identifies a specific individual watch as the prize, that individual watch will be supplied unless substitution becomes reasonably necessary and is permitted by applicable law and the Competition Rules.
  8. Where local sourcing is not practical, the Promoter may arrange fully insured international delivery from the UK or another appropriate location.
  9. The method of fulfilment will be communicated to the winner before shipment or collection.
  10. The winner is responsible for ensuring that they may lawfully import, possess and receive the prize.
  11. Unless the Competition Rules expressly state otherwise, an international winner is responsible for any:
    • customs duty;
    • import VAT;
    • sales tax;
    • use tax;
    • customs clearance fee;
    • local registration cost;
    • income or prize tax;
    • reporting obligation; or
    • other charge imposed by their jurisdiction as a result of receiving or owning the prize.
  12. Where local sourcing removes the need for an international import, the winner remains responsible for any personal tax or reporting obligation that independently applies to the prize.
  13. If the advertised prize cannot lawfully or reasonably be delivered to the winner, the Promoter will consider a lawful alternative fulfilment method.
  14. Where permitted, this may include an equivalent prize or another solution stated in the Competition Rules.
  15. A cash alternative is not automatically available internationally.
  16. Where a cash alternative is offered, its amount and eligibility will be stated on the competition page or in the Competition Rules.
  17. For UK entrants, a cash alternative may be offered where expressly stated for the competition.
  18. For international entrants, any cash alternative remains subject to applicable law, banking restrictions, tax requirements and the Competition Rules.
  19. Unless expressly permitted by the Promoter, a prize is not transferable to another person before it has been validly claimed.

Winners & Verification

  1. All prize awards are subject to verification.
  2. The Promoter may require a potential winner to provide:
    • government-issued identification;
    • proof of age;
    • proof of residence;
    • proof that the payment method used belonged to or was lawfully available to the Entrant;
    • bank-account details where a lawful cash prize is payable;
    • tax information where required;
    • a correctly answered skill-testing question where required; and
    • other information reasonably required to verify eligibility and prize fulfilment.
  3. A potential winner is not finally confirmed until required verification has been satisfactorily completed.
  4. The Promoter will contact a winner using account contact details as soon as reasonably practicable after winner identification.
  5. The winner must respond and complete the required claim process within the period stated in the Competition Rules or, where no period is stated, within 14 days of the first reasonable winner notification.
  6. If a potential winner:
    • cannot be contacted after reasonable attempts;
    • does not respond within the required period;
    • fails eligibility verification;
    • fails a mandatory skill-testing requirement;
    • provided materially false information;
    • is prohibited from receiving the prize; or
    • otherwise fails to comply with these Terms,
    the Promoter may treat the prize as forfeited and select or determine an alternative eligible winner in accordance with the Competition Rules and applicable law.
  7. Where applicable, major prize winners will be published on the Winners page.
  8. We may publish a winner's first name, general location and winning entry information where reasonably required for transparency or compliance.
  9. If applicable law requires winner information to be supplied to an authority, regulator or advertising body, we may do so notwithstanding a winner's request not to participate in publicity.

Payments, Refunds & Chargebacks

  1. Paid entries are not valid until payment has been successfully authorised and the entry accepted by our systems.
  2. Payments are processed through third-party payment providers and may be subject to their terms, fraud controls and verification procedures.
  3. Unless required by applicable law, a valid completed competition entry cannot normally be cancelled or refunded simply because an Entrant has changed their mind.
  4. This does not affect any non-excludable statutory consumer right.
  5. If a competition is cancelled without a valid winner being awarded and cannot lawfully or reasonably be completed, the Promoter will deal with affected paid entries in accordance with applicable law and the relevant Competition Rules.
  6. If a payment is reversed, charged back, cancelled, fraudulent or otherwise not ultimately received by the Promoter, any associated entry and any prize attributable to that entry may be suspended or voided, subject to applicable law.
  7. An Entrant must not initiate a dishonest or knowingly false chargeback.
  8. Where an Entrant believes there has been a payment or entry error, they should first contact hello@thecalibreclub.com so that the transaction can be investigated.
  9. Currency conversion costs, international card charges or other fees imposed independently by an Entrant's bank or card issuer are the Entrant's responsibility.

Fair Play & Disqualification

  1. The Promoter may refuse, suspend or disqualify entries where there is reasonable evidence of:
    • fraud;
    • payment fraud;
    • multiple accounts;
    • false identity or residency information;
    • automated entry abuse;
    • bot activity;
    • hacking;
    • tampering with competition software;
    • attempting to discover or exploit winning positions;
    • chargeback abuse;
    • circumventing entry limits;
    • circumventing geographical restrictions; or
    • other conduct intended to obtain an unfair advantage.
  2. A disqualification decision will be based on the information reasonably available to the Promoter and will be applied consistently and in accordance with applicable law.
  3. The Promoter may preserve relevant transaction, security and audit information where reasonably required to investigate fraud or defend a legal claim.
  4. Nothing in this section gives the Promoter a right to cancel a legitimate winning entry merely because the prize value is high or the outcome is commercially inconvenient.

Data Protection & Publicity

  1. Personal data is processed in accordance with the Promoter's Privacy Policy and applicable data-protection law.
  2. Information may be processed for purposes including:
    • creating and administering customer accounts;
    • processing payments and entries;
    • fraud prevention;
    • competition administration;
    • winner verification;
    • prize fulfilment;
    • customer support;
    • legal and regulatory compliance;
    • draw verification; and
    • marketing where the appropriate consent or lawful basis exists.
  3. We may share information with service providers reasonably necessary to operate the competitions, including payment processors, technology providers, delivery providers, fraud-prevention providers and draw-verification providers.
  4. International prize fulfilment may require personal information to be shared with dealers, couriers, customs agents, professional advisers or authorities in the winner's country or region.
  5. A winner may be invited to participate in photographs, video or other publicity.
  6. Except where expressly required by the Competition Rules or applicable law, promotional photography or filming is voluntary.
  7. A winner who does not wish to participate in promotional publicity should tell us.
  8. We may nevertheless publish or disclose limited winner information where required to demonstrate that a valid prize was awarded or to meet applicable legal or regulatory requirements.
  9. Data-protection rights may be exercised as described in our Privacy Policy. Certain information may still need to be retained where there is a legal, regulatory, fraud-prevention or claims-related requirement to do so.

Liability, General & Governing Law

Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation where applicable.

Subject to applicable law, the Promoter is not responsible for indirect or consequential losses arising solely from participation in a competition or acceptance of a prize.

The Promoter is not responsible for taxes, duties, travel costs, insurance, registration or other personal expenses associated with a prize unless expressly included in the Competition Rules.

Changes, suspension and cancellation

  1. The Promoter may amend these Terms prospectively where reasonably necessary.
  2. Material changes will not be used retrospectively to deprive an Entrant of a prize validly won under the rules applicable when that entry was accepted.
  3. The Promoter may suspend, cancel, amend or postpone a competition where reasonably necessary because of:
    • law or regulatory requirements;
    • fraud;
    • technical failure;
    • payment-provider failure;
    • force majeure;
    • prize unavailability;
    • security incidents; or
    • other circumstances outside the Promoter's reasonable control.
  4. The Promoter will not extend a competition solely because insufficient paid entries have been sold unless the published Competition Rules expressly provide for that possibility and the extension is lawful.

Third-party platforms

Unless expressly stated otherwise, competitions promoted through Facebook, Instagram, Meta, Google, TikTok or another third-party platform are not sponsored, endorsed, administered by or associated with that platform.

Severability

If any provision of these Terms is found invalid or unenforceable in a particular jurisdiction, that provision will be interpreted or limited to the minimum extent necessary and the remaining provisions will continue to apply where legally permitted.

Governing law

These Terms and the relationship between the Promoter and Entrant are governed by the laws of England and Wales, subject always to any mandatory rights or protections that apply to consumers in their country, state, province or territory of residence and which cannot lawfully be excluded by contract.

Subject to those mandatory rights, the courts of England and Wales will have jurisdiction over disputes arising from these Terms.

Local rules

Where applicable law requires jurisdiction-specific Competition Rules, permits, authorities, registrations, disclosures or entry procedures, those provisions form part of the contract for Entrants in that jurisdiction.

If participation would be unlawful notwithstanding the Competition Rules, the affected person must not enter.
